PostcardMania SEO Services Terms & Conditions

By signing up for SEO services you are agreeing to the following terms and conditions. You are:

• Granting PostcardMania permission to make changes to your website based on SEO best practices
• Granting PostcardMania full access to your website properties.

MANAGEMENT SERVICE FEES TO POSTCARDMANIA

You understand that, without further notice to you, PostcardMania will charge your provided credit card for your first monthly service fee as soon as your SEO account setups are fully complete and that PostcardMania will continue to charge you a monthly service fee until you request cancellation. There will be a one-time set-up fee charged during the first month of service, plus a monthly fee. You may choose to be billed monthly or pay for twelve months of service upfront to receive a discount on the monthly price. The prices are as follows:

Billed Monthly 

• $995/month for the SEO Basic Package, plus a one-time $1,995 setup fee.
• $1,595/month for the SEO Moderate Package, plus a one-time $2,995 setup fee.
• $2,395/month for the SEO Advanced Package, plus a one-time $3,995 setup fee.

Billed Annually 

The annual billing option includes the one-time set up fee and a discounted monthly rate.

• $12,735 total for setup and a year of service with the SEO Basic Package ($1,200 savings discounted to $895/month)
• $19,735 total for setup and a year of service with the SEO Moderate Package ($2,400 savings discounted to $1,395/month)
• $27,935 total for setup and a year of service with the SEO Advanced Package ($4,800 savings discounted to $1,995/month)

One Time Fee 

• For a one time fee of $500, we will create and optimize your Google Business Profile Profile.

Introduction & Terminology 

The use of the terms “PCM,” “PostcardMania,” “we,” “our” and “us” in the following document refer to Joy Rockwell Enterprises, Inc. D.B.A. PostcardMania, located at 2145 Sunnydale Blvd., Building #102, Clearwater, FL 33765.

PostcardMania provides various marketing products and services including, but not limited to, direct mail marketing, web site design, email marketing, consultation and evaluation.

The use of the terms “you,” “your,” “company” and “customer” in the following document refer to any person or company or agent authorized to represent your company who orders, requests or uses any of PostcardMania’s web design services.

The use of the term “SEO” in the following document refers to Search Engine Optimization, which is the process of improving the volume and/or quality of traffic to a web site from search engines through organic (or unpaid) search results.

As an SEO customer, you agree to be bound by the following.

Client Must Acknowledge the Following with respect to SEO services: 

• PostcardMania has no control over the policies of search engines with respect to the types of sites and/or content that they accept now or in the future. Your website may be excluded from any directory or search engine at any time at the sole discretion of the search engine or directory.
• Due to the competitiveness of some keywords, changes to search engine algorithms, and other competitive factors, PostcardMania does not guarantee #1 positions or consistent top 10 positions for any keyword, phrase or search term.
• Google has been known to hinder the rankings of new websites. PostcardMania assumes no liability for ranking/traffic/indexing issues related to a newly built website.
• Linking out to spammy websites or getting links from a paid link service can seriously damage all SEO efforts. PostcardMania does not assume liability if you choose to link out to or obtain a link from any external website without prior consultation, or if you have done so in the past.
• PostcardMania is not responsible for your company overwriting SEO work done to your site (i.e. if you upload over work that has already been provided, or on a page that’s already been optimized).
• Your website’s ranking in search engines can fluctuate any day or time due to on-going changes in the search engine’s algorithms, or based on SEO efforts made by PostcardMania, competitors, or both.
• All front-facing (non-code related) content changes will be sent to you for review, but will be implemented at PostcardMania’s discretion.

PostcardMania’s SEO Services Will Include (but are not limited to)

• The first month of service includes a full SEO audit. This audit looks at rankings, traffic (if applicable), as well as content, on-page elements and technical aspects of your website. PCM will also set up Google Properties for your website in Google Analytics, Google Tag Manager and Google Search Console if this hasn’t been set up already.
• Up to one hour of phone consultation per month.
• Monthly reporting that includes but is not limited to organic traffic, conversions, keyword rankings, review trends, clicks to your website, etc.
• Google Business Profile management including the creation and/or optimization of your business’ profile, which includes but is not limited to writing and uploading a business description, Google Business Profile posts, and uploading photos.
• Keyword and topical research to target the most relevant search terms for your business
• Obtaining “backlinks” from general and local directories in order to drive more traffic and authority to your website
• Finding and adjusting inconsistent business names, addresses, and phone numbers wherever your business is listed
• Editing and optimizing your website’s pages for various elements including metadata, headers, text, and links as needed on 3 pages of your website at a time.
• Analysis and recommendations on optimal website structure, navigations, and code for technical SEO best practices
• Creating new content, one page at a time, for your website based on SEO best practices and keyword research.
• Generating email campaigns to gather reviews from your customers
• Optimizing points of conversion on your website to help more visitors become leads/customers

Authorization & Permission

You hereby grant PostcardMania permission to access your hosting and directory accounts and information and to use them and change them as needed to provide the services you have requested.

You hereby grant PostcardMania permission to publicize your information and the information we create for you to web search engines, web directories, indexes, PCM portfolios, web sites, web pages, publications and any other places we deem necessary or appropriate.

You agree to provide the logins and passwords we require when they are requested and necessary for us to provide you with the services you have ordered.

You agree to grant PostcardMania manager/edit access to Google Analytics, Google Search Console and Google Business Profile, and to use or change them as needed to provide the services you have requested.

If you wish to run a review gathering email campaign, you agree to provide a list of customer email addresses when they are requested so that we are able to move forward with the review gathering service.

We will never intentionally use or share your provided customer information for our own benefits. We will never sell this information.

PROVISION OF THE SERVICE 

1.1 To optimize your website using SEO best practices in order to increase the amount of traffic and conversions on your website via organic search.

1.2 You will be able to contact your account manager who will be available during normal office hours.

2 TERM AND TERMINATION

2.1 Cancellation at any other time by either party is subject to a notice period of one calendar month. If you wish to cancel your service please contact your Account Manager. You will be invoiced for one further month from the date we receive your cancellation email. If you disable our access to your website during the month’s notice period you will be invoiced for that remaining month.

2.2 You have the option to pause our service for up to a maximum of three months. If you have not resumed your service by the end of the three month period then we will automatically cancel your contract and issue you with a final invoice to cover your cancellation period.

2.3 PostcardMania reserves the right to revise the terms and conditions of this agreement with one month’s notice.

3 CHARGES & BILLING

3.1 All charges will be made to your nominated Credit Card.

3.2 If you wish to change the credit card from which we take payments please contact your Account Manager. For security purposes please do not include credit card details in emails – PostcardMania will arrange to receive your new card details by phone, fax, or secure online form.

3.3 If we are unable to take payment for our service fees our Accounts Department will notify you by email or in writing. For non-payment, at PostcardMania’s discretion, the Contract shall be deemed to be terminated by you, along with any other contracts that are held with us, and the full value of the remaining term/cancellation period of the Agreements becomes due.

SECURITY

4.1 You must immediately inform PostcardMania if there is any reason to believe that a user ID or password has been or is likely to be compromised or used in an unauthorized way.

4.2 PostcardMania reserves the right to suspend access to the Service if at any time PostcardMania considers that there is or is likely to be a breach of security.

5 CONFIDENTIALITY

5.1 We agree not to disclose or otherwise make available to anyone confidential information relating to your SEO services.

6 LIMITATION OF LIABILITY

6.1 In no event will PostcardMania be liable to you for any indirect, incidental or consequential loss or damages arising under this Contract.

6.2 You agree to indemnify and keep PostcardMania indemnified from any claim brought by a third party resulting from PostcardMania’s provision of this service to you limited to infringement by you of any intellectual property right of any kind, infringement by you of any legislation or regulation affecting PostcardMania’s performance of its obligations under these Conditions.

6.3 In the case that you may have us assist you in creating your account with Google or Bing, you understand than any terms, conditions, privacy or legal agreements of any kind that are made with Google or Bing during account creation and management are agreements between you and Google or Bing, not between PostcardMania and Google or Bing.

7 MATTERS BEYOND EITHER PARTY’S REASONABLE CONTROL

7.1 If either party is unable to perform any obligation under this Contract because of a matter beyond that party’s reasonable control that party will have no liability for failure to supply the Service. If any of these events continue for more than 2 weeks either party may serve notice on the other terminating this Contract.

8 ASSIGNMENT

8.1 You will not assign, resell, sublease or in any other way transfer the Service (or any element thereof), or any of its rights or obligations under the terms of this Contract without the prior written consent of PostcardMania. Contravention of this restriction in any way, whether successful or not will entitle PostcardMania to terminate the Service and/or the Contract immediately. PostcardMania may assign or transfer its rights or obligations under this contract by written notice to you.

9 DATA PROTECTION

9.1 PostcardMania is committed to protecting your privacy.

10 LAW

10.1 This Contract is governed by and shall be construed in accordance with the laws of the United States of America and the State of Florida and the parties submit to the exclusive jurisdiction of the US and Florida State courts.

11 YOUR AUTHORITY

11.1 You assert that you are a person employed by the company purchasing/signing up for SEO Services, that you have the authority to make decisions concerning this company’s web presence, and that you have the authority to promise payment for the services rendered by PostcardMania. You assert that you have read and that you understand fully the contents of this document including the payment promised by you to PostcardMania and the services promised by PostcardMania to you.
